2026 Aircraft Auctions are starting out with some of the nicest flying and project aircraft available. This auction will have some equipment and small items listed in it, too.

Agreement to Terms: By registering to bid in any auction, whether live, simulcast or online only, conducted by Grady Auctions & Realty, Inc. (“Auctioneer”), the bidder (“Bidder” or “Buyer”) acknowledges and agrees to be bound by these Terms and Conditions. All auctions are conducted in U.S. Dollars.

Buyer’s Commission: A buyer’s premium of ten percent (10%) will be charged on the first $100,000 of each item, and five percent (5%) will be charged on that amount above $100,000.01, with a maximum buyer’s premium of $50,000 per item.

Sales Tax: Sales tax will be collected when applicable. Although Auctioneer attempts to disclose known tax information for each aircraft and its location, Buyer is solely responsible for determining and paying any applicable taxes unless valid exemption documentation is provided prior to payment. Each state has different tax regulations, and Buyer is encouraged to perform independent due diligence regarding tax obligations.

Registration Requirements: To register, all bidders must provide a valid credit card with at least a $500 limit. The credit card provided at registration will be verified for $500.00 for authorization purposes only. This verification is not a charge, but the authorization may temporarily reduce the card’s available balance. International bidders without a U.S. bank account must provide a $20,000 deposit to register. Nothing will be charged to the card unless the Buyer fails to pay or make payment arrangements within 48 hours of the auction close.

Payment Terms and Buyer Default: Payment may be made by ACH transfer, wire transfer, credit card (for items under $5,000 only, with a 4% convenience fee), or cash where permitted. All invoices over $5,000 must be paid by Wire or ACH by the stated deadline. By registering, Buyer authorizes Auctioneer to charge the credit card on file for invoices totaling $500 or less, for a $500 deposit on larger invoices, and for any applicable surcharges. If payment is not made on time, Auctioneer may charge the card on file with an additional 5% surcharge. Failure to pay constitutes default, in which case any deposit or credit card charge is forfeited as liquidated damages. Auctioneer may resell the item, and Buyer will be responsible for any resale deficiency, storage fees, collection costs, and attorney fees. Interest accrues on unpaid balances at 1.5% per month.

Inspection and Buyer Responsibility: All property is sold strictly ASIS, WHEREIS, with all faults and without any warranties of any kind. Buyer is solely responsible for inspecting the property, including aircraft condition, logbooks, airworthiness, AD and SB compliance, damage history, equipment functionality, and all other matters. Auctioneer and Seller make no representations or guarantees regarding the accuracy of descriptions, year, make, model, serial number, times, hours, logbook completeness, airworthiness, or suitability for any purpose. All statements made by Auctioneer or Seller are opinions only and shall not be relied upon as factual. Buyer agrees that they are not relying on any oral or written statements outside this Agreement. We welcome and encourage you to inspect / preview the assets being sold in this auction. Most items are located in locked hangars and on municipal airports behind secured gates with limited access. You will need to make arrangements to gain access to aircraft which may require a appointment. Aircraft Condition, Airworthiness, and Disclaimers: Auctioneer does not represent that any aircraft is airworthy, capable of being flown, eligible for a ferry permit, or compliant with FAA regulations. Buyer assumes all risks associated with inspection, operation, movement, and regulatory compliance. Auctioneer and Seller have no duty to inspect, verify, or confirm any information provided.

Auctioneer attempts to provide accurate information, such as year, make and model, hours, times, O/H dates, etc. in the auction listing. HOWEVER, the auction catalog is provided for reference only. Buyer's are responsible for verifying information on their own prior to bidding. We do not guarantee year, make, models, mileage, hours, etc. If an issue is noticed during listing, Grady Auctions & Realty, Inc makes every reasonable effort to disclose and report it. If an issue arises at any point after the item is declared sold, it is the buyer's responsibility.

Buyer understands and expressly agrees any statements or representations concerning the value, condition or quality, useful life, or use of the item made by the owner or Auction Company to the buyer is simply opinion, not statements of fact, and does not create any promise, warranty, or guarantee for the buyer's benefit. It is the buyer's sole responsibility to physically inspect items prior to bidding or have a buyer designated representative inspect the item. In no event shall Auctioneer be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor.

Indemnity and Hold Harmless: Buyer agrees to indemnify, defend, and hold harmless Auctioneer, Seller, and their employees and agents from any claims, injuries, damages, losses, or liabilities arising from inspection, operation, movement, removal, storage, environmental issues, or Buyer’s breach of this Agreement. A separate Indemnity & Hold Harmless Agreement must be signed before removal of any aircraft, helicopter, experimental aircraft, or project aircraft.

Closing Documents and Title Processing: Payment for aircraft is made directly to Auctioneer, while closing documents are handled digitally through AIC or another qualified title company. The title company provides documents only and does not handle funds. Escrow is not used unless specifically authorized in writing.

Removal, Storage, and Shipping: Buyer is responsible for all shipping, transportation, and related costs. No item may be removed until paid in full. Small items must be removed within seven days. Sellers typically provide hangar or tiedown rent through the end of the auction month; thereafter, Buyer must arrange and pay for continued storage.

Online Bidding and Technology Limitations: Online bidding is provided as a convenience, and Auctioneer is not responsible for internet failures, software errors, server outages, device malfunctions, missed bids, time delays, or proxybid malfunctions. Auctioneer may extend, reopen, or cancel bidding, withdraw items, or recatalog items at its discretion.

Reserves and Seller Confirmation: All items are sold subject to seller confirmation, and reserves may be placed by the Seller, Seller’s agent, or Auctioneer on the Seller’s behalf.

Governing Law, Venue, and Attorney Fees: This Agreement is governed by the laws of the State of Arkansas. Any dispute must be brought exclusively in the courts of Jackson County, Arkansas, or the U.S. District Court for the Eastern District of Arkansas. Buyer consents to jurisdiction and venue in these courts, and the prevailing party is entitled to recover attorney fees and court costs.

Contact Consent and Privacy: By registering for this auction, Buyer expressly consents to receive emails, text messages, and other communications from Grady Auctions & Realty, Inc. regarding this auction, future auctions, marketing announcements, and related updates. Buyer may unsubscribe from marketing communications at any time by using the optout instructions provided in each message.

Grady Auctions & Realty, Inc. does not sell, rent, or knowingly disclose Buyer’s personal information to any third party, except as necessary to process payments, conduct the auction, comply with legal requirements, or facilitate title and closing services. Buyer acknowledges that registration information is used solely for auction operations, bidder verification, communication, and compliance purposes.

Entire Agreement: This Agreement constitutes the entire understanding between the parties and may not be modified except in writing signed by Auctioneer. If any provision is found invalid, the remainder shall remain enforceable.
